The 8% VAT rate applies under Resolution 204/2025/QH15 until 31 December 2026. From 1 October 2026 a deposit of one month's gross salary per person is required, refunded when the contract ends and is settled; there is no onboarding, offboarding, entity-setup or currency-conversion fee. Pay for staff in central Ho Chi Minh City must not be below the Region I minimum wage of VND 5,310,000 per month (Decree 293/2025/ND-CP). Which legal routes does EOR use in Vietnam?
Nhan Kiet operates two statutory routes. The first is labour sub-leasing under the 2019 Labour Code and Decree 145/2020/ND-CP: staff report directly to your manager, for the 20 jobs listed in Appendix II of Decree 145/2020/ND-CP, for up to 12 months per person (Article 53 of the 2019 Labour Code). The second is a service contract under the Commercial Law, used for work outside that list or engagements longer than 12 months; Nhan Kiet then directs the staff and is responsible for the results. The right route is agreed before signing.
What about foreign experts working in Ho Chi Minh City?
